JUSTICE SANDEEP KUMAR ORAL ORDER 05-07-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Buniyadganj P.S. Case No. 61 of 2023, registered for the offence punishable under Section 30(a)(b)(c) of the Bihar Prohibition and Excise Amendment Act, 2018.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner has got clean antecedent. The alleged recovery of liquor is made from the bushes of the river which does not belonged to the petitioner. Petitioner is in custody since 23.02.2023.

Learned APP has vehemently opposed the prayer for bail of the petitioner.
