Counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.

The petitioner is apprehending his arrest in a case registered under Sections 147, 148, 149, 307, 504 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that the accused persons along with 20 unknown persons came to the informant and enquired from him as to why he was playing cricket on the ground situated in Mohalla Khajasarai. Co-accused Ratikant Jha and Prakash Mallick took out pistol from their waist and fired shots on the

Patna High Court CR. MISC. No.35226 of 2020(2) dt.19-03-2021 2/3 informant which hit on his thigh causing bleeding injuries. Thereafter he was taken to the Hospital for treatment. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is not named in the F.I.R. His name has come in this case in course of investigation. The petitioner had no knowledge regarding the alleged occurrence. The main allegation is against the co-accused Ratikant Jha and Prakash Mallick, who have been granted anticipatory bail by a coordinate Bench of this Court vide Annexure 3 to the present application.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Darbhanga in connection with Laheriasarai P.S. case No.164 of

Patna High Court CR. MISC. No.35226 of 2020(2) dt.19-03-2021 3/3 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
