The petitioner seeks bail in Atri P.S. Case No.243 of 2020 registered under Sections 272 and 273 of the Indian Penal Code and under Sections 30(a)(d) of Bihar Prohibition and Excise Act.

The informant after having received secret inputs about the preparation of illegal Mahua liquor raided a place situated near brick-kiln in the village Jota. Seeing the police, accused persons started fleeing away but petitioner was apprehended. 25 litres of country made liquor made of Mahua was recovered. 13 pouches of country made liquor made of Mahua was also recovered. 1500 litres Jawa Mahua made for preparation of liquor was also found.

Patna High Court CR. MISC. No.34443 of 2020(2) dt.20-01-2021 2/2 The learned counsel for the petitioner submits that petitioner is in jail since 27.07.2020 and he has got no criminal antecedent. About 30 litres of Mahua liquor was recovered and the remaining was raw material for which small quantity of liquor can be prepared.

Taking into consideration the facts aforesaid and nature of allegation made against the petitioner and the fact that petitioner is in jail for about six months and he has got no criminal antecedent, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special judge, Excise, Gaya in connection with Atri P.S. Case No.243 of 2020.
