2. The petitioner apprehends arrest in connection with Sarbahda P.S. Case No. 91 of 2025 instituted under Sections 30(a) and 37 of the Bihar Prohibition and Excise Amendment Act, 2022.

3. As per the prosecution case, during police patrolling, recovery of 82.440 liters of illicit foreign liquor and an Apple iPhone was made from a damaged Scorpio vehicle.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. The name of the petitioner has come in the self inculpatory statement of the co-accused. The petitioner has similar antecedent under the Excise Act also.

7. Considering the aforesaid fact, this is not a fit case for grant of anticipatory bail.
