2. The petitioner is apprehending his arrest in a case in connection with Pandarak P.S. Case No. 83 of 2018 dated 20.08.2018 registered for the offences punishable u/ss 323, 307, 379, 387 read with section 34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have holding country made pistol came and put the pistol on the temple of the informant's son and demanded Rs. 50,000/-. When the informant came to rescue, the petitioner and the co-accused persons assaulted the informant severely. During the course of assault, they also snatched golden chain and earring from the informant.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.42439 of 2023(5) dt.06-11-2023 2/2 that the petitioner has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner and the petitioner has no concern with the alleged offence. It is further submitted that the petitioner has never demanded any money from the informant's son. The petitioner has one criminal antecedent as stated at para 3 of the bail petition.
5. Learned A.P.P. for the State has vehemently opposed the anticipatory bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Barh, Patna in connection with Pandarak P.S. Case No. 83 of 2018, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
7. The application stands allowed.
