The petitioner apprehends his arrest in Dhoraiya P.S. Case No. 41/2013, registered for the offences punishable under Sections 406, 420, 467, 468, 471, 120B of the Indian Penal Code. The informant made allegation of cheating, misappropriation and use of public money against the non-banking financial institutions. On 08.03.2013, during inspection of nonbanking institution Apna Pariwar Agro Farming Developers India Ltd. the police found five persons at the office in which petitioner is also included which would appear from paragraph 11 of the F.I.R.
It is submitted that Angad Kumar was Office-in-Charge and other three persons were employee of that non-banking
Patna High Court Cr.Misc. No.16325 of 2016 (2) dt.10-05-2016 2/2 financial institution. Petitioner is neither employee nor agent of that company. It appears that no sorts of allegation is made against the petitioner and save and except the name of petitioner mentioned at Sl. No. 5 in the Investigation Report there is no tangible material against him.
Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Dhoraiya P.S. Case No. 41/2013, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
