JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 11-07-2019 The writ application as framed does not call for any adjudication by this Court sitting in its writ jurisdiction. The facts narrated in the writ application are only repeatedly saying that there is a piece of land with respect to which the petitioner is claiming its ownership. It is not being allowed to be enjoyed because of the hindrances which are being created by the local criminals allegedly in collusion with the State respondents such as Circle Officer and the local police.

Learned counsel for the State has rightly submitted

Patna High Court CWJC No.13122 of 2019(3) dt.11-07-2019 2/2 that this is a purely law and order issue which the petitioner is agitating before this Court. It is also informed that there is perhaps a title suit in respect of the land. The petitioner claims that it is neither plaintiff nor defendant in the said title suit. In the totality of the facts and circumstances of the case, this Court grants liberty to the petitioner to bring the entire facts to the notice of the District Magistrate-cum-Collector, Patna by way of a detailed representation with all supporting materials which shall be considered by the District Magistrate (respondent no.3) and if required in order to maintain the law and order, adequate direction may be issued to the concerned authorities. The respondent no.3 shall consider and dispose of the representation of the petitioner as regards the law and order issues without going into any question of title of the property.
