JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-03-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 417,419,420,467,468,471,474,406,409 and 120B of the Indian Penal Code.

It is alleged that the family members of the petitioners procured loan of Rs.44,41,924 under KCC scheme on the basis of forged land possession certificate for an area of 123.91 acres whereas Jamabandi in favour of petitioner are only for 13.11 acres of land.

It is submitted by the learned counsel for the petitioners that the accusation has been levelled against the entire famly. The

Patna High Court Cr.Misc. No.13256 of 2015 (2) dt.31-03-2015 2/2 Punjab National Bank has issued a certificate (Annexure 2) that the bank has no objection with regard to the loan on KCC accounts of the petitioners. It is further submitted that co accused Madan Singh and Gayatri Devi have been granted anticipatory bail vide Cr. Misc. No. 23936 of 2014.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Sherghati, Gaya in connection with Imamganj P.S. Case No. 162 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
