The petitioner is in custody in connection with Mairwa P.S. Case No. 465 of 2018 for the offence under Sections 341, 323, 324, 307, 504/34 of the Indian Penal Code. Allegation against the petitioner is that he has given Chhura blow on the nephew of the informant.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 17.04.2019. He submits that the injury on the informant's nephew is simple in nature and the informant and the petitioner are own brother.

Considering the fact that the petitioner and the informant are own brother and the injury is simple in nature, the
