JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-01-2022 Heard both parties through video conferencing. The petitioners seek bail in Bakhtiarpur P.S. Case No. 281 of 2020, registered for the offence punishable under Sections 363, 366(A) and 34 of the Indian Penal Code. As per the FIR, all the FIR named accused persons and four unknown kidnapped the minor daughter of informant for the purpose of marriage.

It is submitted on behalf of the petitioners that petitioner are not named in the FIR. During course of investigation, name of petitioners have come in this case on the statement of victim girl under Section 164 Cr.P.C. wherein she has stated that she was kept at the house of petitioners who are

Patna High Court CR. MISC. No.47682 of 2021(3) dt.07-01-2022 2/2 Mami and Mama of the main accused Ravi Kumar Aman. Petitioners are in custody since 31.05.2021. Petitioner no. 1 has got clean antecedent. Chargesheet has already been submitted. Considering the facts and circumstances of the case, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Bakhtiarpur P.S. Case No. 281 of 2020.
