1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Khodawandpur (Chhaurahi O.P.) Police Station Case No. 105 of 2017, dated 10.07.2017, disclosing offences under Sections 467/468/471/420/120B/34 of the Indian Penal Code.
3. The prosecution case, as per the First Information Report, is that pursuant to the order passed by this Court in CWJC No. 15459 of 2014, for verification of educational and training certificates of contractual teachers appointed since 2006 in Begusarai and Khagaria Districts, the
2/4 Vigilance Department started investigation and found that some candidates got the government job as teacher on the basis of fake teachers training certificate and marksheet.
4. Mr. Y. C. Verma, learned senior counsel for the petitioner submits that the petitioner is not an appointee, rather, he is a Panchayat Secretary, who retied in the year 2014. He next submits that the petitioner is not named in the First Information Report and his name has transpired during course of investigation. As per the counter affidavit filed by the Vigilance, only allegation which emerges is that the certificate submitted by the main accused in this case, namely, Abhilasha Kumari, was attested by the petitioner. Learned counsel further submits that all the certificate, including the certificate of BTET-2011 of Abhilasha Kumari, which was found to be forged, was only attested by the petitioner. There was no mechanism to verify the genuinity of the certificates at the time of appearance of the candidate before the Selection Committee.
5. On the other hand, Mr. Arvind Kumar, learned counsel for the Vigilance, vehemently opposes the prayer for anticipatory bail and submits that the petitioner was one of the members of the Selection Committee and also the
3/4 Secretary of the Panchayat. He next submits that as per rule, it was his duty to verify the genuinity of the BTET certificate produced by Abhilasha Kumari before attestation. The petitioner failed to discharge his duties as Secretary and attested the BTET certificate of Abhilasha Kumar facilitating her to get employment on the basis of fake and forged BTET certificate.
6. Regards being had to the submissions made on behalf of the parties and taking into consideration the fact that allegation against the petitioner is based upon document for which custodial interrogation may not be required, I am inclined to grant the petitioner privilege of anticipatory bail.
7. This application is, accordingly, allowed.
8. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Manjhaul at Begusarai, in connection with Khodawandpur (Chhaurahi O.P.) Police Station Case No. 105 of 2017, subject to the condition laid down under
