JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 13-03-2015 The petitioner being husband of the complainant apprehends arrest in Complaint Case no. 1411-C of 2012 instituted under section 498-A of the Indian Penal Code and section 3⁄4 of the Dowry Prohibition Act.

Learned counsel for the petitioner draws the attention of this Court to the order passed by the Principal Judge, Family Court, Munger whereby it is recorded that the petitioner has divorced the complainant Opposite Party No. 2 under the Muslim customs and by agreeing to pay certain alimony to the wife.

Considering the aforesaid, in the event of arrest or

No.36220 of 2014 (2) dt.13-03-2015 surrender of the petitioner above named within four weeks from today, he shall be released on bail on furnishing bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-divisional Judicial Magistrate, Khagaria in connection with Complaint Case No. 1411-C of 2012 subject to all conditions as laid down in section 438(2) of the Code of Criminal Procedure, 1973.
