The petitioner being the husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 498A/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

The basic accusation is of torture for non-

Patna High Court Cr.Misc. No.16562 of 2016 (5) dt.17-10-2016 2/3 fulfillment of the dowry demand.

The petitioner and the informant are present in the Court.

Counsel for the petitioner submits that the petitioner admits his marriage with the informant but is not ready to keep the informant as wife due to past conduct of the informant.

Counsel for the informant submits that the informant is ready to resume the conjugal life. The matter was adjourned on the joint prayer of the parties for resolving the issue in terms of payment of one time settlement amount but the issue could not be resolved as there difference persisted on the quantum of one time settlement amount. Though, the petitioner has preferred Matrimonial Suit No. 161 of 2015 with a prayer for dissolution of the marriage after lodging of the FIR.

Keeping in view of the fact that the issue does not likely to be reconciled, let the learned court below consider the prayer for bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Majorganj P.S. Case No. 160 of 2015 pending in the court of learned Chief Judicial
