Case No.297 of 2013 instituted under Section-379/414 of the Indian Penal Code.

Learned counsel for the petitioner draws attention to the order of the learned Session Judge who has noted the facts to show that it is not the petitioner who had stolen the pump set nor it was recovered from his house. It is only on the statement of a coaccused that the petitioner's name came in this case.
