The petitioner seeks bail in Chenari P. S. Case No. 17 of 2019 instituted for the offence under Section(s) 376, 511/34 of the Indian Penal Code and Sections 8 and 12 of the Protection of Children from Sexual Offences (POCSO) Act. Learned counsel for petitioner submits that petitioner is not named in the written report.

In the written report it is alleged that victim and her sister had gone to Karamchat dam on motorcycle along with Laljit Kumar and Krishna Yadav. It is further alleged that while they were returning from the Dam then one person stopped the motorcycle and told that he is a police personal and 4-5 persons

Patna High Court CR. MISC. No.34993 of 2019(3) dt.27-06-2019 2/2 came there and tried to commit rape with the informant as well as her sister. When they raised alarm then nearby people came there and and one person, namely, Nanhak Paswan was arrested and the informant and her sister were taken to CRPF camp.

During investigation, the name of this petitioner has come in the confessional statement of Nanhak Paswan. Petitioner is in custody since 24.1.2019 having no criminal antecedent. .

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-1st Rohtas at Sasaram in connection with Chenari P. S. Case No. 17 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
