ANJANA MISHRA ORAL ORDER 30-01-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The The petitioner being a Branch Manager of Madhya Bihar Gramin Bank, Branch Dihra, who is alleged to have misappropriated money to the tune of Rs. 393805.50, is apprehending his arrest in connection with Obra P.S. Case No. 150 of 2014, registered for offences punishable under Sections 409 and 420 of the Indian Penal Code.
Learned counsel for the petitioner submits that whatever amount is due from the Bank as alleged, the petitioner is willing and ready to deposit the same and hence he may be extended the privilege of pre arrest bail.
In view of the stand taken by the petitioner and his undertaking that he shall deposit the alleged amount, let the
Patna High Court Cr.Misc. No.14666 of 2015 (6) dt.30-01-2016 2/2 petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order along with the receipt showing the deposition of said amount, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Obra P.S. Case No. 150 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
It is made clear that the amount referred to above is a pre condition for grant of benefit of anticipatory bail and he shall be released only thereafter.
