JUSTICE SATYAVRAT VERMA ORAL ORDER 18-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Maniyari P.S. Case No. 102 of 2021, 24.03.2021, N.D.P.S. Case No. 27 of 2021 instituted for the offences under Sections 414 and 34 of the Indian Penal Code read with Sections 20 and 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985. Learned counsel for the petitioner submits that the petitioner is in custody since 26.03.2021, is a person with clean antecedent and charge-sheet has been submitted in this case. Allegation is of recovery of 500 gram Charas from possession of the petitioner.

Learned A.P.P. for the State vehemently opposes the

Patna High Court CR. MISC. No.47755 of 2021(2) dt.18-01-2022 2/2 prayer for regular bail of the petitioner and submits that allegation is of recovery of half of the commercial quantity from the petitioner.

Considering the fact that 500 grams Charas like substance is alleged to have been recovered from the petitioner, the Court is not inclined to grant bail to the petitioner for the present in connection with the aforesaid case pending in the Court of learned 4th Additional Sessions Judge-cum-Special Judge, Muzaffarpur.
