The petitioners apprehend their arrest in connection with Turkaulia P.S. Case No. 698/2015 registered for offences punishable under Sections 147, 148, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code.

It is contended on behalf of the petitioners that prior to this case, a first information report was lodged by mother of the informant. So far the allegation is concerned, it is general and omnibus save and except on Safi Ahmad who is stated to have assaulted by farsa on the head of the brother-in-law of the

Patna High Court Cr.Misc. No.16601 of 2016 (3) dt.24-05-2016 2/2 informant. It is contended that eight persons were assaulted but the injury report shows that there is only one injury which is on the chest and the same is simple in nature.

Having regard to the facts and circumstances of the case, let the petitioners, namely, Nuroolah, Saheb Alam, Ekbal Ahmad, Saidur Rahman, Faijur Rahman and Bhutta be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Turkaulia P.S. Case No. 698/2015, on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
