Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case registered for the offence under Sections 8/ 20 (C)(iii) (C) of N.D.P.S. Act. The prosecution story, in brief, is that total 363 kgs., of Ganja is alleged to have been recovered from the Truck bearing Registration No. HR-55R-9465. The petitioner is said to be the Khalasi of the Truck in question.

This is second attempt on behalf of the petitioner for grant of bail.

Earlier bail application of the petitioner was rejected

Patna High Court CR. MISC. No.35617 of 2020(3) dt.03-03-2021 2/2 vide Cr. Misc. No. 6295 of 2019 under order dated 16.04.2019 by a Bench of this Court taking into account that total 363 kgs., of Ganja was said to have been recovered from the Truck in question. The petitioner was Khalasi of the Truck in question. The same was above the commercial quantity and the petitioner was not entitled for grant of bail in light of Section 37 of the N.D.P.S. Act.

A report was called for from the court below regarding the present stage of the case. It has been reported that all the nine witnesses have been examined and the trial is likely to be concluded within a period of two months. Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected in connection with Hajipur Town P.S. Case No. 209/18, pending in the court of learned Additional District and Sessions Judge-Ist-cum-Special Judge, Vaishali at Hajipur. Learned court below is directed to take all necessary steps to conclude the trial at the earliest.
