1. Heard Mr. Indrajeet Bhushan, learned counsel for the petitioner and Mr. Ram Sumiran Rai, learned APP for the State.
2. Petitioner apprehends his arrest in connection with Manjhagarh P.S. Case No. 95 of 2024 dated 28.03.2024 registered for the offences punishable under Sections 489-A, 489-B, 489-C and 34 of the Indian Penal Code.
3. As per the prosecution story, on 28.03.2024 around 2:20 p.m, police received a tip-off that Sandeep Kumar Yadav of Madhusareya Mathiya Tola was storing counterfeit currency. A raid team was formed and reached the location at 3:35 p.m. Sandeep tried to flee but was caught. A personal search recovered 31 fake Rs. 500/- notes from his pocket. A search of his house uncovered 146 more fake Rs. 500/- notes and 298
Patna High Court CR. MISC. No.39771 of 2025(4) dt.03-09-2025 2/3 fake Rs. 100/- notes, totaling Rs. 1,02,800/- in face value, all with identical serial numbers. During interrogation, Sandeep confessed that the notes were supplied by Bunty Kumar and Suresh Kumar (Petitioner). He also admitted to his prior arrest with them in a similar counterfeit currency, case (Goreakothi P. S. Case No. 110/21, dated 24.06.2021.

The main submissions advanced by petitioner's counsel are that the alleged fake Indian currency notes were recovered from the possession of the co-accused Sandeep Kumar Yadav and his house and the name of this petitioner surfaced only in the statement of the apprehended co-accused Sandeep Kumar Yadav, except this, there is no material to establish his involvement in the alleged offences relating to the recovery of fake currency notes.
5. Learned APP appearing for the State has opposed the bail prayer of the petitioner.
6. Heard both the sides and perused the FIR and case diary. The instant matter relates to the recovery of large quantity of Indian fake currency notes though the recovery was made from the possession of the co-accused Sandeep Kumar Yadav and his house, however, the name of this petitioner has emerged as being involved in supplying the seized notes to the
Patna High Court CR. MISC. No.39771 of 2025(4) dt.03-09-2025 3/3 apprehended accused and further, the petitioner has previously been an accused in Goreakothi P.S. Case No. 110 of 2021 which was registered for similar nature of offences. Considering all these facts and pending of investigation, this court is not inclined to grant the relief of anticipatory bail to the petitioner. Accordingly, his prayer stands rejected.
