JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-09-2021 The instant case has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.
The present writ petition has been filed for directing the respondent authorities to make payment of the admitted outstanding dues to the tune of Rs.4,11,584/-, for the goods and
services provided to the respondent authorities by the petitioner in terms of the bills annexed as Annexure-2 series to the present writ petition.
At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Director General of Police, Bihar, Patna for redressal of her aforesaid grievances.
The learned counsel for the respondent State, Shri Suman Kumar Jha, AC to AAG-3 has got no objection. Accordingly, the present writ petition stands disposed of with liberty to the petitioner to approach the Director General of Police, Bihar, Patna and in case appropriate representation is filed within a period of four weeks from today, with regard to payment of the admitted outstanding dues, the Director General of Police, Bihar, Patna shall consider the same in accordance with law and pass a reasoned and a speaking order within a period of six weeks of receipt of such representation and in case any outstanding admitted dues are found payable, the same shall be paid within a further period of eight weeks, thereafter. It is needless to state that in case the Director General of Police, Bihar, Patna finds that admitted outstanding dues are payable to the petitioner and the same are not paid within the time frame
stipulated, herein above, the same shall carry interest @ 12% per annum from the day the same became due till the date of payment.
