JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-04-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468/34 of the Indian Penal Code.

The prosecution case is that at the examination being conducted for recruitment of Fireman in C.I.S.F, in the biometric test, it was found that one Bhavesh Kumar came to appear in place of Pawan Kumar while this petitioner was appearing in place of his brother Dinesh Kumar. It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled, whereas Dinesh Kumar has been granted regular bail. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner

Patna High Court Cr.Misc. No.18372 of 2016 (2) dt.28-04-2016 2/2 surrenders within a period of six weeks in connection with NTPC P.S. Case No. 42 of 2015, pending in the Court of learned Chief Judicial Magistrate, Bhagalpur.

With the observations above, the application stands disposed of.
