The petitioner seeks bail in Jandaha P.S. Case No. 92 of 2021, registered for the offence under Section 302/34 of the Indian Penal Code.
As per the prosecution case, on 01.05.2021, son of the informant had gone to consume todi (rkM+h) at the shop of the petitioner, but till night, he did not return and thereafter, on the next date, the dead-body of son of informant was found behind the house of the petitioner.
It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case. Informant is not eyewitness to the occurrence and petitioner has been made accused only on suspicion. In fact, the petitioner had not taken any loan
Patna High Court CR. MISC. No.47966 of 2021(3) dt.07-01-2022 2/2 from the son of the informant and as such, there is no question of any altercation with the deceased. Petitioner claims clean antecedent and he is in custody since 03.05.2021. However, learned A.P.P. for the State opposed the bail petition and submitted that there is specific allegation against this petitioner and the dead-body of the son of informant was found behind the house of the petitioner.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
