2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 412 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of Arms Act.
3. Prosecution case relates to loot in the office of Flipkart by the unknown miscreants. On the basis of secret information, police apprehended some accused persons who disclosed the name of the petitioner. From their possession, police recovered country made pistol, live cartridges, knife and one bag containing Rs. 4,90,260/-
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

Petitioner is not named in FIR rather his name came on the basis of disclosure made by apprehended accused persons. Petitioner was neither apprehended on spot nor any incriminating article has been recovered from his conscious possession. It is further submitted by learned counsel for the petitioner that petitioner has not been put on TI parade. Moreover, the petitioner is languishing in judicial custody since 12.12.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6.Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Chiraiya P.S. Case No. 551 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari.
