The petitioner apprehends his arrest in Siwan (Thawe) RPF Case no. 2/14, registered for the offences punishable under Sections 3 R P (UP) Act.
The informant alleged that on 10.06.2014 the petitioner and two other persons picked up quarrel and snatched Rs. 3000/- from his possession.
It is submitted that the occurrence took place on 10.06.2014 and the present case was lodged on 10.07.2014. Prior to lodging of the present case, on the same and similar facts, Siwan (Thawe) GRP Case no. 31/2014 was registered under Section 379 and other Sections of the Indian Penal Code on
Patna High Court Cr.Misc. No.15002 of 2015 (2) dt.12-05-2015 2/2 11.06.2014. The allegation of theft was found false. The petitioner was granted bail by the police.
Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Sonepur, Saran in connection with Siwan (Thawe) RPF Case No. 2/14, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
