The petitioner has preferred this application for grant of regular bail in a case registered under section 363 of the Indian Penal Code.

As per the prosecution case, the son of the informant who went out did not return. Subsequently a message was received from his mobile phone that he had drunk liquor and would return once the effect of liquor ends. However, he did not return.

It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The dead body of the son of the informant was found in Nepal. The petitioner's name transpired in the confessional statement of Dilip Kumar

Patna High Court CR. MISC. No.48320 of 2021(4) dt.07-04-2022 2/2 made before police. The said Dilip Kumar has been enlarged on bail vide order dated 24.3.2021 passed in Cr. Misc. No. 548 of 2021. The petitioner is in custody since 10.12.2020. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case specially grant of bail to co-accused Dilip Kumar on whose confessional statement before the police the name of the petitioner transpired together with the petitioner having remained in custody for more than 1 year, , the petitioner is directed to be enlarged on bail in connection with Ahiyapur P.S. Case no. 863 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Muzaffarpur (East), District Muzaffarpur.
