JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 20-02-2015 The petitioners apprehend their arrest in Barachatti P.S. Case No.73 of 2014 instituted under Sections- 147, 148, 149, 341, 323, 448 and 365 of the Indian Penal Code. The informant is the wife of one Maheshi Singh Bhokta who is said to have taken away by the petitioners and others. It is also alleged that after taking away he had been beaten and abandoned in the jungle from where he was recovered by the villagers.
Learned counsel for the petitioners states that the parties are in litigating terms from before. In a case Maheshi Singh is an accused and the petitioners are part of the prosecution party
Patna High Court Cr.Misc. No.35251 of 2014 (02) dt.20-02-2015 2/2 and it is only to terrorize them this false case has been instituted. He also submits that this Court has granted anticipatory bail to some of the other co-accused persons in similar circumstances vide order dated 06.02.2015 passed in Cr. Misc. No.33542 of 2014.
Be that as it may, in the event of arrest or surrender within four weeks from today, the petitioners, namely, Lalo Singh Bhokta and Degan Singh Bhokta shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Sherghati, Gaya in connection with Barachatti P.S. Case No.73 of 2014, subject to all conditions as laid down in Section-438(2) of the Criminal Procedure Code.
