JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 03-07-2015 Heard the learned counsel for the petitioner and the complainant.
Petitioner is the neighbour of the complainant and is facing accusations punishable under Sections 376, 511, 323 and 380 of the IPC.
The allegation is that while the parents of the prosecutrix were away the petitioner after ascertaining the same forcibly took her to the nearby maize field and tried to commit rape inasmuch as disrobe her. On raising alarm, the parents arrived and he was escaped. Later the allegation is that he along with other committed theft of certain articles.
Patna High Court Cr.Misc. No.6861 of 2015 (4) dt.03-07-2015 2/2 Contention of the petitioner is that both of them are neighbours and small scuffle used to ensue every now and then. The complaint has been lodged after two days. The allegation is false and concocted with a view to defeat the grudge. Learned counsel for the complainant, on the other hand, submitted that in course of enquiry the parents have fully supported the allegation.
Considering the facts and circumstances of the case, I am not persuaded to extend the benefit of anticipatory bail to the petitioner. Prayer for bail is rejected. (Kishore Kumar Mandal, J) Shyam/- U T
