JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-05-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Vigilance P.S. Case No.39 of 2013, disclosing offences under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code and Sections 7, 10, 13(3) read with Section 13(1) (d) of Prevention of Corruption Act, 1988.
Patna High Court Cr.Misc. No.19235 of 2016 (2) dt.16-05-2016 2/3 Learned counsel for the petitioner, at the very outset, drawn my attention to an order of this Court, dated 20.08.2015, passed in Cr. Misc. No.33686 of 2015, whereby, considering general nature of accusation, with respect to irregularity committed in issuance of coupons to persons below poverty line and distribution of food-grains, co-accused, namely, Nikhil Ranjan Kumar, has been granted the privilege of anticipatory bail.
I find substance in the submission made on behalf of the petitioner. This application is, accordingly, allowed. Let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance North Bihar, Muzaffarpur, in connection with Special Case No.27 of 2013 arising out of Vigilance P.S. Case No.39 of 2013, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the
Patna High Court Cr.Misc. No.19235 of 2016 (2) dt.16-05-2016 3/3 event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
