2. The petitioner has preferred this application for grant of regular bail in connection with Kuchhila P.S. Case No. 09 of 2025 dated 11.04.2025 registered for the offences punishable u/ss 109 of the B.N.S. and Sections 25(1-B)(a), 26 and 27 of the Arms Act.
3. As per the prosecution case, on 11.04.2024, when the informant reached his house from Kochas and saw one person was sitting in the courtyard. The informant inquired about him, he disclosed his identity as his relative, in the meantime, the informant asked to his son Sumit Kumar about the said unknown person then the accused person pulled out

No.37945 of 2025(3) dt.18-08-2025 2/3 firearms from his waist and fired on the informant's son from country made pistol which hit in his right thigh due to which he fell down on the ground. Thereafter, the informant caught hold of the accused person then he again fired. After hearing the alarm, villagers assembled there then the accused person tried to flee away but he was caught by villagers. Thereafter, the injured was taken to the hospital for treatment and apprehended person was handed over to police.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. There is case and counter case between the parties. Nothing has been recovered from the conscious possession of the petitioner. As per the injury report of the injured, the injury nos. 1 and 2 are simple in nature caused by hard and blunt object. The petitioner has no concern with the alleged offence. The petitioner has two criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 15.04.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-

No.37945 of 2025(3) dt.18-08-2025 3/3 named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Kaimur (Bhabua) in connection with Kuchhila P.S. Case No. 09 of 2025 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
7. The application stands allowed.
