JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 05-05-2016 Heard learned counsel for the petitioners and learned counsel appearing for the State.

Petitioners apprehend their arrest in a case under section 302/34 of Indian Penal Code and 3(i)(x) of the ST/SC Act. Informant stated that his younger brother, Madan Lal, went to the house of Prakash Manjhi and Ramesh Rai for taking wine. The aforesaid persons assaulted him by legs and fists and when he became injured then they threw him near the bank of river Ganga.

Learned counsel for the petitioners submits that the allegations are false. There is no eye witness to the alleged occurrence.

As the petitioners are named in the F.I.R., I am not

Patna High Court Cr.Misc. No.16720 of 2016 (2) dt.05-05-2016 2/2 inclined to grant anticipatory bail to them. Prayer for anticipatory bail of the petitioners is refused with direction to surrender and seek regular bail which would be disposed of on its own merit without prejudice, preferably on the same day.
