2. Heard learned counsel for the petitioner and learned A.P.P for the State.

3. The petitioner has preferred this application for grant of regular bail in connection with N.D.P.S. Case No. 57/ 2022 arising out of NCB Case No. 29/ 2021 dated 26.05.2022 registered for the offences punishable u/ss 8C, 21C, 22C and 29 of the Narcotic Drugs and Psychotropic Substances Act.

4. As per the prosecution case, Alprazolam-315 gms, Morphine-270 gms and brown colour Patthar (stone)-500 gms were recovered from the possession of the co-accused Madan Singh Sondhiya. The petitioner and the co-accused persons were apprehended. It is further alleged that the petitioner was receiver

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner rather the seized contraband has been recovered from the possession of the co-accused Madan Singh Sondhiya who disclosed the name of the petitioner. The petitioner is accused in six other criminal cases as stated in para 3 of the bail petition. The petitioner is in custody since 26.01.2022.

6. Learned A.P.P. for the State has vehemently opposed the prayer of bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhojpur at Ara in connection with N.D.P.S. Case No. 57/ 2022 arising out of N.C.B Case No. 29/ 2021.

8. The application stands allowed.
