Learned counsel for the petitioner, learned counsel for the State and learned counsel for the NHAI have appeared. The order of the Commissioner-cum-Arbitrator has been challenged in this Court.

The proper forum for challenging that order is the Court of District Judge under Section 34 of the Arbitration and Conciliation.

Learned counsel for the petitioner is permitted to withdraw this application and file the same before the District Judge concerned within 30 days from today.

If the same is filed within 30 days before the District Judge concerned, the case shall be heard on merits and the limitation shall be condoned.
