Mr.Kalyan Shankar ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 11-07-2019 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in S.Tr. No. 356/2018, arising out of Pawna P.S. Case No. 39/2018, instituted for offence under Section(s) 302/34 of the Indian Penal Code. Learned counsel for the petitioner has submitted that other co-accused with identical allegation has already been granted bail by this Court vide order dated 09.04.2019 passed in Cr. Misc. No. 22614/2019.

It is alleged in the written report that sister-in-law of informant had gone outside after taking meal at 10:00 AM for picking garbage. At 7:00 PM in the evening she returned. At that time, three persons of village Maniyach speaking like

Patna High Court CR. MISC. No.37475 of 2019(3) dt.11-07-2019 2/2 Mushahar caste whom she could not identify took her sister-inlaw towards field. She did not come in the night. On the next day, she got information from co-villager that one lady is lying half-dead on the border of Khopira-Maniyach. Informant went there and saw her sister-in-law from whose mouth and nose blood was coming. She was brought to hospital. She died in course of treatment. Informant raised suspicion against those accused persons, who had taken her sister-in-law with them. Petitioners are in custody since 16.07.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge Xth, Bhojpur at Ara, in connection with S.Tr. No. 356/2018, arising out of Pawna P.S. Case No. 39/2018, subject to the conditions that both the bailors shall be the close relative of the petitioners.
