The petitioner seeks pre-arrest bail in connection with Baikunthpur P.S. Case No. 169 of 2014 registered for the offences punishable under sections 147, 149, 341, 323, 307, 353, 379, 384, 504 and 354 of the Indian Penal Code. According to the prosecution case, the informant who is principal of the school and her son Nirbhay Pratap Singh were assaulted by the accused persons including the petitioner. The entire occurrence took place in the chamber of the School Principal. There is allegation that one of the accused persons outraged her modesty too.
Learned counsel for the petitioner has contended the
Patna High Court Cr.Misc. No.14231 of 2015 (3) dt.02-09-2015 2/2 one of the accused namely Raman Kumar Kashyap has already been granted anticipatory bail in Criminal Misc. No. 12264 of 2015. It has been further contended that the F.I.R. has been registered as the petitioner and others used to highlight the irregularities being committed by the informant. Regard being had to the serious nature of allegation which took place in the premises of school, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail is rejected.
In case the petitioner surrenders and seeks bail, the same shall be considered on its own merit without being prejudiced by the order passed by this Court. (Ashwani Kumar Singh, J) sushma/- U
