JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 23-08-2017 Heard learned counsel for the petitioner and the learned counsel representing the State.

The petitioner wants to renew the prayer of pre-arrest bail which was earlier rejected by order dated 28.04.2017 passed in Cri. Misc. No. 10994 of 2017, on the ground that against the petitioner there is nothing. It is fact that N.G.O. "Gram Seva and Sambhardhan Parisad" which was running by the petitioner have received Rs. 65,99,000/- but that was real claim and not false claim. The operation was done properly, other co-accused have been allowed bail and, as such, the petitioner also deserves sympathetic consideration.

In the facts and circumstances stated above, considering the allegation attributed against the petitioner and finding no good ground for reconsideration of prayer of the bail, again prayer of the pre-arrest bail of the petitioner stands rejected in connection with Special Case No. 07 of 2012 arising out of Bhabua P.S. Case No. 533 of 2011, pending in the court of learned Special Court Vigilance 1st Patna.
