2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 467, 468 , 471 , 401 , 413 , 414 and 34 of the Indian Penal Code .

3. As per the prosecution case, the stolen motorcycle was recovered from the house of co-accused Ramnath Jaiswal.

4. Learned counsel for the petitioner submits that only on the basis of confessional statement of other co-accused person he has falsely been implicated in this case . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery . The main accused person namely Ramnath Jaiswal has already been granted bail by learned Court below

Patna High Court CR. MISC. No.44048 of 2024(2) dt.24-07-2024 2/2 vide order dated 26.04.2024 passed in B. P No. 800 of 2024 .

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate First Class, East Champaran in connection with Piprakothi P.S. case No. 36 of 2024 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
