ANJANA MISHRA ORAL ORDER 08-04-2016 Heard learned counsel for the petitioners and learned counsel for the informant as well as learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 147/149/323/307 and 302 of the Indian Penal Code. Diary in this case was called for earlier which has since been received.

Learned counsel for the petitioners submits that though they are named in the First Information Report, the only allegation against these petitioners is that they have used bricks and stones for attacking members of the prosecution party. Learned counsel for the informant, however, submits the persons were injured on account of the act of the present

Patna High Court Cr.Misc. No.3523 of 2016 (3) dt.08-04-2016 2 / 2 petitioners along with other co-accused persons. Learned counsel appearing on behalf of the State after perusal of the case diary submits that save and except the allegation of having attacked with brick and stones, there is no other allegations against these petitioners.

Considering the facts and circumstances and also that the petitioners have no criminal antecedent, let the petitioners above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Pakaribarawan P.S. Case No. 64 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
