JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 20-02-2015 Prayer for anticipatory bail of petitioner no.2 is permitted to be withdrawn as he has already been arrested. Petitioner no.1 apprehends her arrest in a case under sections 341,323,376,506/34 of the Indian Penal Code, on the allegation that she facilitated her husband, Sonu Kumar to commit rape on Mamta, who is said to be the daughter of elder sister of petitioner no.1.
The petitioner submits that she has falsely been implicated in this case. Further, there is no allegation that she caught hold of the victim at the time of commission of the office.
In the facts of the case, in the event of arrest/surrender, let the petitioner no.1 as mentioned above, be released on bail on furnishing bail bond of Rs.5,000/- with two sureties of the
Patna High Court Cr.Misc. No.35756 of 2014 (2) dt.20-02-2015 like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Bikramganj, Rohtas in Dinara Police station Case No. 72 of 2014.
