JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 28-01-2016 In the present application under Articles 226 and 227 of the Constitution of India, the prayers made by the petitioners in para-1 are as under :- "1. That this writ application is being preferred on behalf of the petitioner above named for the following reliefs:- (i) For issuance of mandamus to the respondents for taking appropriate and speedy action against the accused persons named in the
Patna High Court Cr. WJC No.395 of 2015 (2) dt.28-01-2016 2/3 FIR as well as against 10-15 unknown persons who were involved in thrashing petitioner No.1 i.e. the informant of the case and the brother and son of the petitioner no.2 as well as the petitioner no.2.
(ii) For directing the respondent authorities for arresting the accused persons as even after more than 3 Months the accused persons are roaming scot free without fear of law and further indulging in tampering with evidences and intimidating the witnesses to become hostile and the said partisan act of the concerned I.O may deprive the petitioners and other victims from getting Justice.
(iii) For directing the respondent authorities especially the I.O of the case not to allow anarchy and chaos to prevail but to act in the interest of justice and in accordance with law. (iv) For any other relief/reliefs as your Lordships may deem fit and proper in the fact and circumstances of the case."
At the outset, learned counsel for the petitioners
Patna High Court Cr. WJC No.395 of 2015 (2) dt.28-01-2016 3/3 submits that since the grievance of the petitioners has already been redressed, he has instructions not to press the application. In that view of the matter, the application is dismissed as infructuous.
