====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-08-2024 Heard learned counsel for the petitioner and Mr. Umeshanand Pandit, learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Alamganj P. S. Case No. 989 of 2023 in a case registered for the offence punishable under Section 365 of the Indian Penal Code.
3. As per the prosecution case on 22.10.2023 at about 11 PM, after talking to one Ruchi on phone for about half an hour, son of informant left the house and did not return. F.I.R. has been lodged against unknown persons.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name transpired during course of investigation. Only material that has come against the petitioner is that tower location of the mobile of petitioner was found in the village of Ruchi and except this
Patna High Court CR. MISC. No.40453 of 2024(4) dt.09-08-2024 2/2 there is no other material available on record to show his complicity in the present case. Petitioner is in custody since 10.01.2024. Police has submitted charge-sheet.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, Patna City, Patna in connection with Alamganj P. S. Case No. 989 of 2023.
