JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 457 and 380 of the Indian Penal Code.
It is alleged that the theft was committed in the house of the informant. The petitioner is not named in the FIR but during investigation it transpired that he was caught using the theft mobile.
It is submitted by the learned counsel for the petitioner that there is no recovery from the petitioner. It is further submitted that though the petitioner was accused in five other cases but he has now been acquitted in all those cases.
Patna High Court Cr.Misc. No.13578 of 2015 (2) dt.07-05-2015 2/2 The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Kotwali (Tilkamanjhi) P.S. Case No. 433 of 2013 pending in the court of learned CJM, Bhagalpur. This application is disposed of with the aforesaid observation/direction.
