The petitioner apprehends his arrest in connection with Nirmali P.S. Case No. 20 of 1999 registered under Sections 341, 323, 504 and 379 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner was on police bail, hence anticipatory bail petition is not maintainable.
However, the trial court may consider to release of the petitioner if petitioner surrender and prays for regular bail in view of fact that petitioner was on police bail.
The bail petition is disposed of with observation abovementioned.
