The petitioner apprehends his arrest for the offences punishable under Sections 147, 148, 149 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

It is submitted that though the name of the petitioner has been shown in the F.I.R. as order giver but he is not the assailant of the deceased as there is specific allegation of assault upon the co-accused, Munna Yadav. It is submitted that one of the coaccused, Misho Yadav has already been granted bail. Having regard to the facts and circumstances of the case, let the petitioner, namely Raj Kishore Yadav alias Chhotelal

No.35799 of 2014 (2) dt.11-02-2015 2 / 2 Yadav, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Muffasil P.S. Case No.67 of 2014, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of C.J.M., Munger subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
