The petitioner seeks bail in Mahnar P.S. Case No. 240 of 2019, registered for the offence punishable punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018. 305.280 litres of foreign liquor has been recovered from one Maruti Car and co-accused Anjan Singh and Sonu Singh were apprehended on the spot.

It is submitted that petitioner is not named in the FIR and his name has surfaced in this case on the basis of confessional statement of co-accused who were apprehended on the spot. Petitioner is neither owner nor driver of vehicle in question and no recovery has been made from conscious possession of this petitioner. Petitioner is in custody since
