The petitioner seeks bail in Khagaria P.S. Case No. 241 of 2021, registered for the offence punishable under Sections 420, 406, 374, 120(B)/34 of the Indian Penal Code. As per the prosecution case, this petitioner who is Cashier along with other co-accused who were on duty to deliver money in ATMs by cash van, misappropriated Rs. 20 lakhs.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case by the informant and he was simply performing his duty. No money has been recovered from possession of this petitioner. During course of investigation, the accused persons stated that one engineer had been allowed to sit in the vehicle namely, Simran.

Patna High Court CR. MISC. No.48240 of 2021(2) dt.23-11-2021 2/2 Petitioner claims clean antecedent and he is in custody since 20.03.2021. Chargesheet has already been submitted. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Khagaria in connection with Khagaria P.S. Case No. 241 of 2021.
