JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-03-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 414, 420, 468 and 201/34 of the Indian Penal Code On information that some vehicles are being cut in the garage of Md Illiyas, a raid was conducted by the police where some cutting instruments were found and other vehicles parked alleged to be stolen, were seized.

It is submitted by learned counsel for the petitioners that the petitioner is not named in the F.I.R. although his name sprang up in the confession of Md. Illias. Md. Illias and other F.I.R. named persons have been granted regular bail vide Criminal Miscellaneous No. 53758 of 2013 and Criminal Miscellaneous No.52586 of 2013.A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the

No.12785 of 2015 (2) dt.30-03-2015 2/2 learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Chandati (Chakand) P.S. Case No.329 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C. The bail bond of the petitioners will be accepted on filing of the affidavit by the petitioners before the learned court below to the effect that they will regularly co-operate in the investigation. Non-cooperation in the investigation by the petitioners will give liberty to the learned court below to cancel the bail bonds of the petitioners.
