JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-05-2015 The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 47(a)(f) of the Excise Act.

From the house of the petitioner, huge quantity of country made and foreign liquor were recovered. It is submitted by learned counsel for the petitioner that for the alleged recovery from the three different places, three F.I.Rs were registered and in all the three F.I.Rs the witnesses to the seizure list are the same. Subsequently the Assistant Commissioner, Excise, Gaya got the matter enquired and found the accusation not true against some of the accused. The aforesaid facts constitute ground for consideration of prayer for regular bail by learned Court below, if the petitioner surrenders within a period of six weeks and pray for regular bail in connection with Excise Case No. 95 of 2012, pending in the Court of learned Chief Judicial

Patna High Court Cr.Misc. No.15981 of 2015 (2) dt.05-05-2015 2/2 Magistrate, Gaya.

Accordingly the application is disposed of.
