1. Heard learned Counsel for the petitioner, learned Additional Public Prosecutor for the State as well as learned counsel for the informant.

2. This application, for grant of anticipatory bail, arises out of C.R. Case No. 1339 of 2024 disclosing offences under Sections 85 of the B.N.S.

3. The prosecution case, as per the First Information Report, is that the petitioner was married with the complainant on 02.06.2023 in a temple and at the time of marriage some gifts were given. After the marriage, the petitioner (accused

No.37364 of 2025(4) dt.15-10-2025 2/3 person) started demanding dowry of Bullet Motorcycle from the complainant and her family members and due to non-fulfillment of the demand the complainant was forcibly sent back to her matrimonial home. It is further alleged that the petitioner is having an illicit relationship with his sisterin-law and also the marriage was not consummated.

4. Learned counsel for the petitioner submits that the petitioner (Husband of the complainant) has falsely been implicated in this case on the basis of false and concocted story. The complainant did not want to live with the petitioner and by making false allegation, the complainant herself left the home of the petitioner. The allegation of demand of dowry is not correct. The learned counsel for the petitioner further submits that the complainant was having an illicit relationship with another person and the petitioner is in custody of many photographs of the complainant taken from the social media showing the objectionable posture of the complainant with another person. The petitioner is not willing to keep the complainant as his wife.

5. On the other hand, learned counsel for the Opposite party No. 2 has vehemently opposed the prayer for anticipatory bail and submits that the matter was referred for mediation by this Court and in the mediation proceedings the

Patna High Court CR. MISC. No.37364 of 2025(4) dt.15-10-2025 3/3 complainant was present on each and every day but the petitioner did not come in the mediation proceedings due to which the same has failed.

6. Having regard to the rival submissions made on behalf of the parties and taking into consideration the fact that there is allegation and counter allegation between the husband and wife and both are at loogerheads, I am inclined to grant the petitioner privilege of anticipatory bail.

7. This application is, accordingly, allowed.

8. Let the petitioner, Manjay Lal Yadav, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Samastipur, in connection with C.R. No. 1339 of 2024, subject to the condition laid down under Section 482(2) of the B.N.S.S.
