The petitioner seeks bail in connection with Jaynagar P.S. Case No. 449 of 2017 registered for the offence under Sections 272, 273 of the IPC and Section 30(a) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 24.04.2023 and he has not been named in the F.I.R and the name of the petitioner has come only on the basis confessional statement.
The allegation against the petitioner is that 10.5 liters of illicit liquor has been recovered from the motorcycle in
Patna High Court CR. MISC. No.38790 of 2023(2) dt.05-07-2023 2/2 question.
Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the period of custody and the recovery, this application for regular bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge (Excise Act), Madhubani in connection with Jaynagar P.S. Case No. 449/2017.
